These terms govern your use of VakilDraft (the "Service"), operated by Malhotra Enterprises, M1 - Narayan Palace, Behind Punjab and Sind Bank, Frazer Road, Patna 800 001, Bihar, India ("we", "us"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
1. What the Service is
VakilDraft is a drafting and research aid for advocates and legal professionals. It prepares first drafts of pleadings and documents, finds judgments and statutory provisions, and checks drafts. It does not give legal advice, is not a law firm, and does not create an advocate-client relationship with anyone.
2. Your responsibility for every draft
Everything the Service produces is a first draft for review by a qualified advocate. Before you file, send or rely on any output you must read it in full; check every fact, date, name, number, section and citation against the record and the law as it stands; complete every placeholder; and satisfy yourself that it is correct and suitable for your matter. The Service marks what it could not verify, but it cannot guarantee that any output is complete, accurate or current. You alone are responsible for what you file or send, and for your professional obligations to your client and the court.
3. Your account
You must give accurate details when you register and keep your password confidential. You are responsible for all use of your account. Accounts are for individual use; do not share them. Tell us at once if you believe your account has been misused.
4. Plans, usage and payment
The Service has a free plan and paid plans. Each plan has usage limits (for example words generated and pages read by OCR), shown on the Pricing and Usage pages; when a limit is reached, the features it covers pause until the limit resets or you upgrade. Paid plans are bought for a fixed period at the price shown at checkout, paid through our payment partner. There is no automatic renewal or auto-debit: you renew when you choose. Refunds are covered by our Refunds & Cancellation Policy. Prices and limits may change for future periods; a period you have already paid for is not affected.
5. Your content
You keep all rights in the facts, documents and drafts you put into the Service. You give us permission to store and process them only to provide the Service to you, as described in our Privacy Policy. You confirm that you are entitled to upload the material you upload, including any client documents, and that doing so does not breach any duty of confidentiality or any law.
6. Acceptable use
Do not use the Service to break the law; to prepare false, frivolous or vexatious proceedings; to harass anyone; to upload malicious files; to copy, scrape or resell the Service or its database of judgments and statutes; to reverse-engineer it; or to interfere with its security or availability. We may suspend or close an account that does any of these.
7. Our content
The Service, its software, and its compilation of judgments, headnotes, holdings and statutory text are ours or licensed to us. You may use outputs in your own professional work. You may not extract or reproduce the underlying database.
8. Availability and changes
We try to keep the Service available and accurate but do not promise that it will be uninterrupted or error-free. We may change, add or remove features. If we make a material change to these terms we will show it in the Service; continuing to use the Service after that means you accept the change.
9. Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, or for any loss arising from a document you filed, sent or relied on without the review described in section 2. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose.
10. Ending your use
You may stop using the Service and ask us to delete your account at any time. We may suspend or end your access if you breach these terms. Sections 2, 5, 7, 9 and 11 continue after your account ends.
11. Governing law
These terms are governed by the laws of India. The courts at Patna, Bihar have exclusive jurisdiction over any dispute relating to them or to the Service.
